The absolute saddest thing about the Supreme Court hysteria is that both side agree that control of that nomination has political implications.
The saddest thing in our nation's history is that they are both right.
Anyone remember those halcyon days when SCOTUS was above political considerations and just ruled based on constitutional law? Boy those were a great few years back in the 18th century. #rgb #scotus #republic
So I'll start things off with a bold statement, though one that has been stated before and with greater skill....
The Bill of Rights was a mistake. It unnecessarily exposed powers that were already denied the federal government- by their exclusion within the body of the Constitution - to the potential for debate. Once debate was engaged, the concept was cemeted that only through the Bill of Rights are these powers limited, thereby granting these powers to the federal government if only an amendmemt could be overcome.
If the Bill of Rights did not exist, the debate would not exist and our rights would no longer be at risk.
