In the United States, a wave of pharma lawsuits against products like Elmiron, Zantac, and IUD ParaGard have been filed as a result of the pharmaceutical industry's negligence. One of these cases that account for the majority is the Truvada lawsuits.

Two of the earliest brand-name HIV drugs created by Gilead Sciences are Viread® and Truvada®. The FDA approved the use of Viread® and Truvada (Tenofovir disoproxil fumarate) for adult HIV patients in 2001 and 2004, respectively, and adolescent HIV in March 2010. The PAC reviewed it and advised regular pharmacovigilance monitoring after hearing it in May 2012, April 2014, and September 2014. On July 16, 2012 the FDA approved Truvada® as pre-exposure prophylaxis (PrEP) for HIV-negative people who are at a high risk of obtaining HIV.

The FDA's Adverse Event Reporting System, or FAERS, collected 11,381 adverse event reports for Truvada between 2005 and September 30, 2019. 718 people died as a result of the approximately 8,982 serious cases among these. Abdominal pain, back pain, depression, diarrhea, skin discoloration and hyperpigmentation, exhaustion, headache, upper respiratory tract infection, and sleeplessness are some of the most typical side effects of Truvada. Loss of bone density, kidney damage, deadly lactic acidosis, and immune reconstitution syndrome are more dangerous adverse effects.

Gilead is being sued for neglecting to disclose the drug's possible hazards despite knowing about them in advance. Additionally, it is charged with withholding the release of Genvoy, a less dangerous medicine, in order to maximize the enormous profits from Truvada. The first round of legal actions against Gilead for Truvada and other drugs based on TDF were filed in March 2018. The federal court in the Northern District of California merged all the Truvada complaints into MDL 2881, presided over by Judge Jon S. Tigar, and the first bellwether case is set to begin in July 2022.

  • Workplace absence records
