1803 Marbury vs. Madison decided that a POTUS can choose a SCOTUS candidate even on the LAST day of their presidency. What the senate has done since then doesn't matter and it has always been up to the party who had the majority in the Senate. Nothing in law to stop TRUMP from doing this constitutional duty.
